General Terms and Conditions of Sale

Article 1 : Application of general conditions of sale

 
These general conditions of sale apply to all ticket orders placed on Grotte Saint-Marcel’s website www.grotte-ardeche.com.
 
The purchaser acknowledges having read these terms and conditions of sale online prior to validating the order. Any validation of the order implies acceptance of the general conditions without exception. Consequently, the purchaser declares and recognizes to have a perfect knowledge of them and thus renounces to refer to any other legal document.
 
The administration of the cave reserves the right to modify or adapt the conditions and terms at any time.  In the event of modifications, the conditions of sale in force on the day the order was placed will be applied to each order.
 

Article 2 : Entrance fees offered for sale online

 
The entrance fees available on www.grotte-ardeche.com are valid on an individual basis:
- for tickets for guided or self-guided tours in the cave
- for gift vouchers
 
Each ticket issued is valid only for the date and/or duration indicated on it.
 

Article 3: Tour prices and order amount

 
The total price at the time of validation of the order is the final price. The ticket prices and the total price of the order are indicated in euros, all taxes included. Grotte Saint-Marcel reserves the right to change its prices at any time.
 

Article 4: The order

 
The online order includes the following steps:
 
1/ The buyer selects the service of their choice. They are informed in real time of the availability of the desired tickets when placing their order.
2/ The buyer creates an account by entering their email address and a password or connects to their account if they have already created one. The creation of the account implies the communication of necessary and obligatory information for the processing of the future order (name, first name, e-mail address, geographical origin).
3/ The summary of the entire order is displayed. After verification of the order, the buyer makes the online payment of their order which is equivalent to the acceptance of these general conditions of sale and cannot be questioned. The buyer communicates in a secure way their credit card details (number and expiry date of the card and cryptogram). In case of refusal of payment by the payment center concerned, the order is automatically cancelled.
4/Tickets ordered on the website can be printed by the buyer or presented directly on the buyer's smartphone at the cave's access control. In both cases, the QRCode (Flashcode) associated with the entrance fee must remain visible for the optical reading made at the access control and thus must not be subtracted from the tickets.
 
 

Article 5: Payment methods and payment 

 
1/ Payment of admission tickets by the buyer is made exclusively in euros and by credit card. The following cards are accepted: CREDIT CARD, VISA, MASTERCARD.
2/ The buyer's bank account is debited with the amount of the order as soon as the transaction is accepted by the payment center.
3/As soon as the transaction is completed, the buyer is informed on the browser window that gave rise to the secure request. They will receive an email confirming the purchase.
4/Payment security: for all payments made when ordering tickets on www.grotte-ardeche.com, Grotte Saint-Marcel uses a secure online payment system that encrypts the buyer's credit card number using the SSL (Secure Stocket Layer) protocol.
 
 

Article 6: Order Confirmation

 
As soon as payment for the order is confirmed by the payment center, the buyer will receive an e-mail confirming their order from Grotte Saint-Marcel's online ticketing service. The e-mail is considered a receipt of the order.
 

Article 7: Liability

 
Except in the case of a malfunction of the www.grotte-ardeche.com website for which Grotte Saint-Marcel would be responsible, Grotte Saint-Marcel shall not be held responsible for any anomalies that may occur during the ordering, processing, downloading, or printing of the ticket.
 

Article 8: Proof, conservation, and archiving

 
The computerized registers, kept in the computer systems of Grotte Saint-Marcel or by any service provider of the latter, in reasonable conditions of security will be considered as evidence of the sales contract, its date of orders and payments made.
The archiving of orders and invoices is made on a reliable and durable support to correspond to a faithful copy, in accordance with the article of the Civil code.
 

Article 9: Data Protection Act

 
When placing an order on the Internet, the buyer is asked to provide personal data (name and surname of the visitor, postal address, e-mail address and/or telephone number). These data are necessary for the processing and follow-up of the said order and are also used in the event of a possible postponement or cancellation of the service to which the entrance fee gives access. The personal data collected are processed by Grotte Saint-Marcel in accordance with Regulation No. 2016/679, known as the General Data Protection Regulation (RGPD) and in compliance with the legal provisions relating to the protection of personal data under Law No. 78 - 17 of January 6, 1978, known as "Informatique et Libertés": The buyer is informed that this authorized processing of personal data has been declared to the National Commission of Computer Sciences and Liberties (Commission Nationale de l'Informatique et des Libertés - CNIL declaration number: 2170711 v0). The buyer has at any time a right of access, modification, rectification, and deletion of personal data concerning them. Subsequently, they can at any time unsubscribe from the list of the newsletter and the list of third parties.

The buyer may consent, at the time of collection of their personal data, to receive newsletters by e-mail. To do so, they just have to check the corresponding boxes on the website.
 

Article 10 : Modification or cancellation at the request of Grotte Saint-Marcel

 
CANCELLATION : Grotte Saint-Marcel reserves the right to cancel the caving and wine-tasting activities if the minimum number of participants is not reached.
Grotte Saint-Marcel reserves the right to cancel or postpone booked visits in cases of force majeure. Any unforeseen and insurmountable event of any kind beyond the control of Grotte Saint Marcel, such as strikes, fire, flooding, inability to access the cave, etc., is considered to be a case of force majeure, without this list being exhaustive. In case of postponement, Grotte Saint Marcel will offer several dates to the customer to postpone their visit, depending on Grotte Saint-Marcel’s availability. If the visit is cancelled or if the offered postponement dates do not suit the customer, the latter may request a refund from the National Treasury (Trésor Public) by written request and will be fully reimbursed for the amounts paid, to the exclusion of any other compensation or damages.
MODIFICATION: If the cave is led to modify the conditions of the planned visits, the customer will be informed in writing or by telephone and will be asked to make their position known within the time limit indicated by Grotte Saint Marcel.
If the customer disagrees with the offered changes within the time limit, thus giving rise to a cancellation of the visit or services concerned, the customer may obtain a refund of the amount of the deposit paid for the reservation, corresponding to the cancelled services. The client's failure to respond within the time limit, or a late response on their part, is equivalent to an agreement on their part to the proposed changes.
 

Article 11 : Conditions of access

 
11.1/ Control of entrance fees
All entrance fees are systematically checked by optical identification of the Qr-code printed on them.
Only entrance fees with a Qr-Code and perfectly legible mentions are accepted. Any partially printed, soiled, damaged, or illegible entrance fee cannot be accepted. Regarding e-tickets, any scratched, damaged, or poorly lit smartphone screen will be refused at the time of access control.
The right of entry is personal and non-transferable.
At the time of ticket control, you may be asked to provide proof of identity or any other proof relating to the fare used.
Grotte Saint-Marcel reserves the right to refuse access to any visitor who does not comply with one of the above conditions.
 
11.2/ Access and compliance with visitor regulations :
Visitors are bound by the rules of Grotte Saint-Marcel. Any visitor who fails to comply with the rules may be refused access to the site without being entitled to a refund of their admission fee.
 
11.3/ Use of admission fees
In the event of a large number of customers visiting the cave, visitors may wait at the cave reception desk.
For entrance fees with guidance or mediation services, visitors must go to the cave reception desk at least 15 minutes before the start of the visit.
The ticket is valid for the day and any exit from the cave is considered definitive; for any reason requiring a new entry after exit, visitors are invited to contact the reception team with their ticket.
 
11.4/ Refund and exchange conditions for entry fees
Entrance fees are not subject to retraction in accordance with ART. L121-21-4 of the Consumer Code (Code de la Consommation).
Entrance fees cannot be refunded or exchanged except in the event of cancellation or change of schedule of the service concerned by the cave.
In the latter case, the purchaser will first be offered a postponement of the service concerned to a different day and/or time. Should this rescheduling fail, the purchaser will have to request a refund of the entrance fee concerned to the National Treasury (Trésor Public) by written request. Only the ticket fee will be reimbursed, no other expenses of any kind will be reimbursed or may be subject to compensation.
The entrance fees may not be resold at a price higher than the face value of the ticket within the framework of the law of June 27, 1919.
 

Article 12 : Fraudulent use, loss and theft of the entrance fee

 
12.1/ Fraudulent use of an entrance fee
The cave will refuse access to the site to any bearer of an entrance fee with a barcode that has already been scanned. Only the first person to present an entrance fee will be admitted. This person will be presumed to be the legitimate owner of the admission right, the buyer being legally responsible for the copies made, in particular from their mailbox.
 
12.2/ Loss and theft of the entrance fee
Grotte Saint-Marcel denies all responsibility in the event of loss or theft of the right(s) issued, including within the physical site.
No duplicate ticket can be issued, including in the event of loss or theft.
 

Article 13 : Complaints

 
Complaints must be sent to Grotte Saint-Marcel within 8 days following the visit, by registered letter with return receipt.
Grotte Saint-Marcel undertakes to provide a written response. The customer's renunciation of one or more services cannot be reimbursed or compensated by Grotte Saint-Marcel. All disputes in relation to the execution or interpretation of this contract must be brought before the courts of Nîmes.
